Terms and Conditions

Welcome to House24 ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the House24 website, mobile applications, and related services (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

"User" means any person who accesses or uses the Platform.

"Agent" means a registered real estate agent or agency using the Platform to list properties.

"Private Seller" means an individual property owner listing their property for sale or rent.

"Listing" means a property advertisement posted on the Platform.

"Content" means all text, images, videos, data, and other materials on the Platform.

3.1 Registration

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4.1 Listing Requirements

When creating a property listing, you must:

• Provide accurate and truthful information about the property
• Have legal authority to list the property
• Use genuine, unaltered photographs of the property
• Comply with all applicable laws and regulations
• Not include discriminatory content or language
• Not misrepresent the property's features, condition, or price

4.2 Listing Approval

All listings are subject to our review and approval. We reserve the right to reject, remove, or modify any listing that violates these Terms or our policies.

4.3 Listing Fees

Listing fees, if applicable, will be clearly displayed before you submit a listing. All fees are non-refundable unless otherwise stated.

4.4 Listing Duration

Listings remain active for the period specified in your subscription plan. You are responsible for updating or removing listings when properties are sold or rented.

You agree not to:

• Use the Platform for any illegal purpose or in violation of any laws
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or harvest user data without consent
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to the Platform
• Use automated systems (bots, scrapers) without permission
• Post spam, advertisements, or promotional content outside of listings
• Infringe on intellectual property rights of others

6.1 Platform Content

All content on the Platform, including text, graphics, logos, images, software, and design, is owned by House24 or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain ownership of content you post on the Platform. By posting content, you grant House24 a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and promoting the Platform.

6.3 Copyright Infringement

If you believe your copyright has been infringed, please contact us at legal@house24.co.za with details of the alleged infringement.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act (POPIA).

8.1 Platform "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 No Verification

We do not verify the accuracy, completeness, or legality of listings or user-provided information. Users are responsible for conducting their own due diligence before entering into any transaction.

8.3 Third-Party Content

The Platform may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites.

8.4 No Real Estate Advice

House24 is a listing platform only. We do not provide real estate, legal, financial, or tax advice. Consult with qualified professionals before making property decisions.

To the fullest extent permitted by law, House24 and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Platform
• Damages arising from user content or conduct
• Damages arising from unauthorized access to your account
• Damages arising from transactions between users

Our total liability to you for all claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or R1,000, whichever is greater.

You agree to indemnify, defend, and hold harmless House24 and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Content you post on the Platform
• Your property listings or transactions

11.1 Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

11.2 Dispute Resolution Process

In the event of a dispute, you agree to first attempt to resolve the matter informally by contacting us at support@house24.co.za. If the dispute cannot be resolved within 30 days, either party may pursue formal legal remedies.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will cease immediately.

Sections that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, indemnification, and limitations of liability.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and House24 regarding the Platform.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
